1. Introduction

These Terms and Conditions of Use describe your rights and responsibilities as a user of the QGov (the System). To create a Queensland Government online QGov Identity and a QGov login account within this system, you must accept these terms. Login accounts held within third party systems are independent of the System, and where enabled in the System may be used in place of your QGov login account. The Queensland Government, and the System, exercises no control or authority over your use of such third party accounts.

Once you have established your QGov Identity, you will be able to access those Queensland Government services that use this system to authenticate end users of their online services.

The Queensland Government (the Department) may make changes to the System and these Terms and Conditions of Use at any time. Your ongoing use of the System constitutes your acceptance of any new Terms and Conditions of Use. The current Terms and Conditions of Use are accessible from the System web pages.

2. Definitions and Interpretations

"Account" means the login account of your choice used to secure access to your QGov Identity. Login accounts control access to websites. Each time you enter a username and password to log in to use an online service (e.g. Google, Facebook or Twitter) you are using a login account for that service. A QGov account is offered to clients who do not wish to use third party login accounts to secure access to their identity.

"Agency" means agencies of the Queensland Government; they offer services for use by customers.

"Agreement" means the arrangement established in accordance with the Terms and Conditions of Use between the Department and you.

"Department" means the Queensland Government, a State or Commonwealth Department or instrumentality, or other Government connecting to the System.

"QGov Identity" means the Queensland Government (QGov) Identity which verifies who you are and enables you to log in once to use multiple Queensland Government online services in a single session. The single log in allows you to view your previous transactions when you return to use a service.

"System" means QGov.

"Third party systems" means a system other than those owned by the Queensland Government.

3. Your Responsibilities

3.1 General

You must:

  • not access or seek to access any other person's QGov Identity;
  • not permit any other person to use your user name and password;
  • keep all private information relating to accounts linked to your QGov Identity, such as your username, password, secret questions and answers secure at all times; and
  • let us know immediately if you suspect that the security of your QGov Identity or any linked login account may have been compromised eg: your password or username has been lost or stolen. Contact the department using the details at Contact us.

You should:

  • change your password regularly; and
  • keep your details up-to-date.

3.2 Lawful purposes

You agree to use your QGov Identity and login account only for lawful purposes and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of the System, or Queensland Government services by any third party. This includes conduct which:

  • is unlawful;
  • may harass or cause distress or inconvenience to any person;
  • involves the transmission of obscene or offensive content; and
  • disrupts Queensland Government services.

You must not post or transmit, via the use of your QGov Identity or login account, any unlawful, defamatory, obscene, offensive or scandalous material, or any material that constitutes or encourages conduct that would contravene any law.

You must abide by all elements within the Queensland Government Acceptable use policy.

3.3 Information that you provide on your QGov Identity

If, within the System or the linked services, you are asked to provide information, the information you supply must be complete and accurate. You acknowledge that if you supply incomplete, inaccurate or false information, the Queensland Government may decide to suspend or terminate your QGov Identity or login account.

3.4 Other Agency terms

When you link to and use Queensland Government services, you may be required to accept and comply with the separate terms of use of those services. Those terms of use are in addition to these Terms and Conditions of Use and, where they relate to the services and your use of them, take precedence over these Terms and Conditions of Use.

By having and using a QGov Identity and login account does not:

  • affect or reduce any obligation any Agency may owe you in respect to the provision of services; or
  • affect or reduce any obligation you owe to any Agency in respect to your receipt of services

3.5 Your QGov Identity and Login Account

If the System is not available for any reason, alternative access to member services may not be available through the relevant Agency's website. However, you can communicate directly with the relevant Agency in writing, by telephone or in person.

3.5.1 Closure

You may close your QGov Identity or login account at any time.

4. Our Responsibilities

4.1 General

The Department will take reasonable care in providing information and services through the System's website. However, the Department does not accept liability for any loss, damage, cost or expense (to any person or property) including consequential or indirect loss or any loss of profits, data or revenue that could arise as a result of your use of the System, including your use of your QGov Identity. Further information is provided in the Disclaimer.

4.2 Privacy Statement

This statement applies to personal information provided in establishing or using your QGov Identity and login account.

The Department collects personal information that you provide through your linked login account, such as your email address and mobile number. We will use your personal information to establish and administer your QGov Identity. Your email address may be returned to an Agency to enable the Agency to contact you.

If available, the following information is returned to agencies that have requested your authentication:

  • your contact email address as supplied by your login account provider;
  • the Australian Business Account (ABA) identifier returned from an ABA log in; and
  • the Australian Business Number (ABN) returned from an AUSkey log in.

Apart from the above information, the Department will only use your personal information, or disclose it to another organisation, or government Agency, for a different purpose if you consent to that other purpose, or that other purpose is required or authorised by law.

To perform more secure online services with the Queensland Government, you will need to strengthen your identity by providing and agreeing to store your personal details:

  • first name;
  • middle name (optional);
  • family name; and
  • date of birth.

These details may only be stored if you provide information from a set of your identity documents that match, and support these details. All documents submitted must successfully verify with the Australian Federal Government Document Verification Service.

To enroll your QGov Identity with a Queensland Government online service, the Agency providing that service will undertake a process to ensure that your QGov Identity is linked to the correct record in the Department's system. That process may require you to share details and provide information relating to your previous interactions with that Agency, and verify contact details.

The Department also collects information about how you use the System's website (such as browsing and searching patterns). The Department collects this information to improve its website service. In doing this, the Department will not identify you, or your use of the website, unless authorised by law.

The Terms of Use and Privacy obligations in your use of third party login account providers apply separately to those of this document. Also, where enabled, the login account provider service which allows you to change your data release permissions recorded.

All efforts to maintain these links will be undertaken however, from time to time, login account providers may change these links, or the content within these links. 4.3 Security

The Department has responsibilities relating to the security of your QGov Identity information and will use all reasonable endeavours to meet these responsibilities.

Your QGov Identity information can only be accessed by department officers who are authorised to access this information. All access by the Department to your QGov Identity and login account is audited and monitored by the Department and officers are trained on a regular basis about their privacy obligations.

The Department will use all reasonable endeavours to ensure that your information is not corrupted or changed.

The Department is responsible for:

  • the security of information while it is collected by, stored on or passing through the System; and
  • the security of the links from the Department's system to systems under the control of Agencies

Agencies are responsible for the security of information while it is collected by, stored on or passing through systems within their control in line with Queensland Government Enterprise Architecture Standard: Information Security IS18.

You are responsible for:

  • protecting your computer with anti-virus, anti-spyware, firewall and anti-spam software, and keeping this software current; and
  • not opening links in emails or attachments if you do not know the sender or are not expecting an email from the System;
  • only downloading files from trusted internet sites.

It is highly recommended that you develop your understanding of security threats posed in the use of online services by consulting sites such as:

The Queensland Government login account is deliberately set up to enforce a strong password. We recommend you maintain a strong password on all online services to safeguard your online activity. The following provides background of this important security measure:

4.4 Linked websites

The Department takes all reasonable care in operating your QGov Identity but the agencies are responsible for authenticating you for the purpose of accessing the services under their control. The Department accepts no responsibility in respect of how the Agency services operate. The Department makes no representation that the material on any linked website does not infringe the intellectual property rights or any other rights of any person. The Department does not authorise or accept responsibility for the reproduction of any material on the System or any linked website. Please refer to our Copyright Statement.

5. General

5.1 Suspension or termination of your QGov Identity for breach of terms

If you breach these Terms and Conditions of Use, the Department may decide to suspend or terminate your QGov Identity and/or login account.

5.2 Severance

If any of these Terms and Conditions of Use are held to be invalid, unenforceable or illegal for any reason, the remaining Terms and Conditions of Use will continue in full force

5.3 Governing law

These Terms and Conditions of Use shall be governed by and interpreted in accordance with the laws and courts of the State of Queensland, and you agree to submit to the exclusive jurisdiction of the courts of Queensland.

5.4 This Agreement

This Agreement constitutes the whole Agreement between the Service Provider and the Client, and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing

5.5 Waiver

None of these Terms and Conditions of Use will be taken to be waived except by written waiver executed between the Department and you.
