Introduction

These Terms of Use describe your rights and responsibilities as a user of a Queensland Government Account (the System).

The Queensland Government may make changes to the System and these Terms and Conditions of Use at any time. Your ongoing use of the System constitutes your acceptance of any new Terms of Use.

A Queensland Government account gives you fast, secure and easy access to Queensland Government online services. Our aim is to ensure that;

  • We make it simple for you to find and access the services you need
  • We present information and services that are relevant to you personally
  • We make it convenient, secure and easy to conduct business online with the Queensland Government
  • We can save you time and improve your online experience by remembering your preferences and pre-filling your details on forms.

Definitions

Within these terms and conditions the following definitions and interpretations will apply;

"Account" refers to your Queensland Government account
"Agency" means an agency of the Queensland Government, the Commonwealth Government or non-government organisations (NGO) that provide Government services
"Login" refers to the username and password used to access your Account. You can either set up a new username and password or re-use your existing Google, Microsoft, AUSkey or myGov (business) login details.
"Dashboard" is the homepage for your Account that is presented on successful login to the System
"System" means the online service which provides a single place to access and view services offered by multiple Agencies (i.e. a consolidated view of your interactions with Queensland Government).
"We" means the Queensland Government, a State or Commonwealth Department or instrumentality, or other Government connecting to the System.

Your privacy is important to us.

We protect your personal information, and will be clear and open about the use of your personal information. The Queensland Government manages personal information in accordance with Information Privacy Act 2009.

We've taken steps to ensure the System enables you to have full control over how your information is used. The following information details how we collect and manage your information.

What information do we collect?

We collect information about you when you use our products or services, or deal with us. We also collect and store information that you provide about yourself.

To provide you with Queensland Government services online, we need to collect certain personal information such as your name, address, phone number, email address, age etc. Personal information is information that identifies you, or from which your identity can be reasonably ascertained.

When you use an existing login, such as Google, Microsoft or myGov, we collect limited personal information through the System and use it to administer and personalise your Queensland Government Account, personalising your online experience.

Existing personal information stored within Queensland Government Agency databases may also be accessed and used to provide services online through your Queensland Government Account.

In addition to the information you have provided to Queensland Government, we also collect information about how you use your account such as browsing and searching. This information is used to enhance your interactions with Queensland Government online services in three ways;

  • To prefill forms to reduce the need to re-enter your details every time you interact with us,
  • To proactively assist you in finding the product, service or information that you are looking for, thus reducing your time and effort to locate services
  • To provide a personalised online service

We also collect general information on how you use the System. This enables us to make improvements to how you interact with the System. No identifying information is collected for this.

Who do we share your information with?

In order for Agencies to deliver the services to you, we may need to either retrieve this information from or provide this information to the Agencies responsible for those services.

We will let you know when this occurs and you have full control whether this information is shared or not. You can change your mind at any time by changing the Sharing Preferences within the Manage Your QGov Identity menu.

We may also use or disclose your personal information in circumstances required or authorised by law.

Keeping your information safe

Ensuring the security and integrity of your information is very important to us.

We are responsible for:

  • the security of information while it is collected by, stored on or passing through the System; and
  • the security of the links from the System to systems under the control of Agencies

We will take reasonable care in providing information and online services we offer. However, we do not accept liability for any loss, damage, cost or expense (to any person or property) including consequential or indirect loss or any loss of profits, data or revenue that could arise as a result of your use of Queensland Government Account. Further information is provided in the Disclaimer.

Agencies are responsible for the security of information while it is collected by, stored on or passing through Systems within their control in line with Queensland Government Enterprise Architecture Standard: Information Security IS18.

What we ask of you

You must:

  • not access or seek to access any other person's Account;
  • not permit any other person to use your username and password;
  • keep all private information relating to your Account and login, such as your username and password, secure at all times; and
  • let us know immediately if you suspect that the security of your Account or login may have been compromised e.g.: your password or username has been lost or stolen. Contact the department using the details at Contact us.

You should:

  • change your password regularly; and
  • keep your details up-to-date.

Here's some steps you can take to generally keep yourself safe online:

  • protect your computer with anti-virus, anti-spyware, firewall and anti-spam software, and keep the software current; and
  • do not open links in emails or attachments if you do not know the sender or are not expecting an email from the sender;
  • only download files from trusted internet sites.

It is highly recommended that you develop your understanding of security threats posed in the use of online services by consulting sites such as:

  • Stay Smart Online; and
  • ScamWatch

Lawful purposes

Your Account must be used only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit the use of the System, or Queensland Government services by any third party. This includes refraining from conduct which:

  • is unlawful;
  • may harass or cause distress or inconvenience to any person;
  • involves the transmission of obscene or offensive content; and
  • disrupts Queensland Government services.

You must not post or transmit, via the use of your Login, any unlawful, defamatory, obscene, offensive or scandalous material, or any material that constitutes or encourages conduct that would contravene any law.

You must abide by all requirements of the Queensland Government Acceptable Use Policy.

Information that you provide

If, within the System you are asked to provide information, the information you supply must be complete and accurate. If you supply incomplete, inaccurate or false information, the Queensland Government may not be able to provide the service you have requested or may suspend or terminate your Account.

How do I access my Queensland Government Account?

To access your Account (www.my.qld.gov.au) you will need a login, either;

  • a Queensland Government login or
  • you can use an existing login, such as Google, Microsoft, AusKey or myGov (business)

After you have logged-in the dashboard of your Queensland Government Account will be presented providing you access to linked online services. Your Account details can be viewed and modified by you on your individual Dashboard. You can manage your personal details and change your sharing permissions on My Details page that is accessible from your Account.

Currently we are improving our services to you, so some functionality will still be within the Manage QGov Login and Manage QGov Identity menus accessible on the login screen. These functions, such as changing your login details, changing your password and viewing your login history will be moved into your Queensland Government Account over the coming months.

Proving your identity

For extra security, certain online services require you to "prove who you are". To prove your identity, Australian and State based identity documents will be electronically verified using the Australian Document Verification System Successful verification will create a digital identity that you can use to access and obtain Queensland Government Services online. This process is an important part of keeping your personal information safe and secure.

By proving your identity, you agree that we can store your personal details, including:

  • given name;
  • middle name (optional);
  • family name; and
  • date of birth.

You retain total control of this information. Refer to Sharing Information above.

Use of Third Party Login Provider

The terms of use and privacy obligations in your use of third party login providers apply separately to those of this Terms of Use document.

General

Other Agency terms

When you link to and use a Queensland Government service, you may be required to accept and comply with separate terms of use specific to the Agency providing the service. The Agency terms of use take precedence over this Terms of Use document, where they relate to the Agency service being obtained.

Having and using a Login to access your Account does not:

  • affect or reduce the obligation of any Agency to provide services to you; or
  • affect or reduce any obligation you owe to any Agency in respect to your receipt of services.

Copyright on this site and in relation to the System is owned by the Queensland Government. For more information please refer to our Copyright Statement.

System availability

If the System is not available for any reason, alternative access to member services may be available through the relevant Agency's website. You can communicate directly with the relevant Agency in writing, by telephone or in person.

Linked websites

The Queensland Government takes all reasonable care in operating your Account but the Agencies are responsible for authenticating you for the purpose of accessing the services under their control.

We accept no responsibility in respect of the Agency services.

We make no representation that the material on any linked website does not infringe the intellectual property rights or any other rights of any person.

We do not authorise or accept responsibility for the reproduction of any material on the System or any linked website.

Suspension or termination for breach of terms

If you breach these Terms of Use, we may decide to suspend or terminate your access to the System and your Account.

Severance

If any of these Terms of Use are held to be invalid, unenforceable or illegal for any reason, the remaining Terms and Conditions of Use will continue in full force.

Governing law

These Terms of Use shall be governed by and interpreted in accordance with the laws and courts of the State of Queensland, and you agree to submit to the exclusive jurisdiction of the courts of Queensland.

This Agreement

This Agreement constitutes the whole Agreement between the Department and you in relation to your Account and the System, and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing.

Waiver

None of these Terms of Use will be taken to be waived except by written waiver executed between the Department and yourself.
